The Bill (Reg. No4420-1) suggests defining: of the principles of the professional ethics of the
public officers; rules of prevention and regulation of the conflict on interests in the activity og the public officers; restriction in connection with the
cessation of the public service; legal status of the authorized body and authorised
persons, activity of which is aimed at the provision of this law implementation;
juridical liability for the infringement of the professional ethics rules of public
officers etc.
In the course of the Committee it was declared that the necessity of the elaboration of the bill is caused by the urgent need in the formation of the legal means system aimed at the elimination of causes and conditions that lead to the corruption actions and crimes in the sphere of official activity.
The principally new for the national legislation is the implementation of the term: "conflict of interest" that presupposes the conflict between the private interests of the public official and his/her duties, availability of which may influence the objectiveness of the decision adoption an also on the commitment or not commitment of actions in the process of his/her official activity.
It is also suggested to define that the law efficiency is spread on the persons that occupy public positions, i.e. fulfill a function of the state and local self-government.
The bill
suggests prevention of the interests conflict through the procedure of the
informing of leaders and authorized persons on the potential conflicts of
interests when appointing to the offices and
in the course of their work, through the elucidative activity of the authorized
persons and also due to the own efforts of the state official aimed at the
prevention of conflict of interests in the course of his service.
The bill also contains the principles on prevention of the receiving by the state official of illegal benefits. Tem "illegal benefit" comprises all the presents and other weal received in the way that contradicts the demands of the legislation in the course of the public service conduction.
The bill suggests regulation of the issue on juridical liability for the infringement of the rules of the professional ethics of the state officials. Pursuant to the document, infringement of the rules of the professional ethics of the state officials attracts holding disciplinary, administrative or criminal responsibility for its commitment.
The People´s Deputies deem necessary to adopt the Bill "On the Professional Ethics in Public Service and Prevention of the Conflict of Interests" (Reg. No.4420-1) to develop a system of legal measures to eliminate the causes and conditions facilitating corruptive actions and crimes in public
